Key facts

  • The buyer contacts a notary, often with a lawyer; the notary prepares the documents and contacts other agencies, while the lawyer checks the property's standing and previous titles.
  • Before a building transfer, the buyer should confirm with the Planning Office that the building matches its construction licence.
  • The notary files a declaration with the competent Tax Agency, and a certified copy is attached to the notarial act.
  • A professional engineer must verify the property's planning status; if the verification is not included in the act, it cannot be registered.
  • The parties sign the notarial act, then the parties or the notary present it to the Land Registry, with registration fees paid on presentation.
  • The Land Registrar or Chief of the Cadastral Office checks legality and registers or rejects the act: immediately in the transcription system, and within 5 days to reject in the cadastral system.
