Key facts
- Registration is the public recording of rights to assets and gives them legal protection against third parties; real estate is registered with the District Commissioner of the district where the property is located.
- If the sale contract, mortgage bonds and title deed are not registered, the buyer's rights are not secure; paid-up loans and expired documents must be deregistered.
- A registered document needs the parties' ID numbers, signing date, delivery date, the real estate number, and two witnesses who certify the date, signature and the parties' financial competence.
- A purchase or mortgage document must state whether the signatory is married and whether the property is the family home; a spouse cannot sell the family home without the other spouse's approval.
- The registration fee is 3,800 ISK per document.
- The stamp fee on transfer documents is 0.8% of the property register valuation for an individual buyer and 1.6% for a legal entity, halved for a first residential purchase.
- Stamp-related documents must be registered within two months of signing; late registration adds a fine of up to 10% of the original stamp duty.
- Only certified estate agents and attorneys may mediate property transactions, and flats in multi-apartment buildings cannot be sold without a joint ownership agreement.
- These pages do not cover title searches, survey checks or foreign-buyer permits.
Steps
- Identify the seller and property details — Gather the seller's contact information and the property's unique reference number.
- Request a title search — Contact the Land Registry of Iceland to request a title search on the property.
- Check for encumbrances — Ensure there are no liens, mortgages, or other encumbrances on the property.
